GENERAL TERMS AND CONDITIONS FOR USING THE WEBSITE OF THE NATIONAL TOLL ADMINISTRATION AT THE ROAD INFRASTRUCTURE AGENCY AND FOR THE SALE OF E-VIGNETTES AND ROUTE PASSES VIA THE WEBSITE, THE MOBILE APPLICATION AND THE SELF-SERVICE TERMINALS
I. What does these General Terms and Conditions apply to
- 1. The Website of the National Toll Administration at the Road Infrastructure Agency at https://www.bgtoll.bg/, as well as https://web.bgtoll.bg/ aims to provide certain services which include the following:
- 1.1. Access to information on the collection of road charges and to the electronic publicly available free registers kept by the Road Infrastructure Agency under the Roads Act;
- 1.2. Possibility for paying vignette fees and issuing e-vignettes;
- 1.3. Validity check of e-vignettes under the registration number of a road vehicle.
- 1.4. Possibility of pre-payment of toll by purchasing a route map;
- 1.5. Verification of the validity of a route pass by the vehicle’s registration number.
- 1.6 Acceptance of enquiries, requests, alerts and complaints by users and stakeholders of the toll network.
- 2. The self-service terminals and the mobile application of National Toll Administration at the Road Infrastructure Agency aim to provide the services under item 1, taking into account the differences in the functioning between the websites, the self-service terminals and the mobile application.
- 3. These general terms and conditions aim to clarify the rights and obligations of the users in relation to the use of the services described in items 1 and 2. These general terms and conditions shall apply from the moment the user starts using the service concerned and shall bind the parties until the service is completed in accordance therewith.
- 4. The users shall be obliged to use the available means for access to services in good faith and for the purposes explicitly stated for the service concerned.
- 5. In case of detection of improper use of the provided means, the relevant service may be refused by the National Toll Administration at the Road Infrastructure Agency.
- 6. When establishing an improper use of the provided means by individual users, the National Toll Administration at the Road Infrastructure Agency reserves the right to restrict the provision of services to entire groups of users, including by stopping individual services or means of communication altogether, in order to ensure that it fulfils its obligations under the laws of the Republic of Bulgaria. In such a case, the damage suffered by conscientious users shall be the responsibility of the persons who, through their improper actions, caused the suspension of the service concerned.
- 7. Any actions with the website, the self-service terminals and the mobile application that are not explicitly allowed should be considered explicitly prohibited.
- 8. If, for the use of a separate service, the user considers that he/she should perform an action that is not allowed, the user should first contact the National Toll Administration of the Road Infrastructure Agency requesting consideration of his/her case. In these cases, the user is obliged to strictly follow the instructions provided by the National Toll Administration at the Road Infrastructure Agency, otherwise his behaviour is considered to be unscrupulous with all the resulting consequences.
- 9. Regardless of the form of use of the website, the mobile application or the self-service terminals, a new session should be started for each use in order to avoid information remaining from previously entered data.
- 10. For certain services, the user needs to enter an e-mail address at which to receive relevant notifications. The entry of an e-mail address in the relevant field constitutes an explicit request to receive the relevant additional service. Failure to enter an e-mail address will not prevent the principled operation of the website, the mobile application and the self-service terminals in relation to toll payment by purchasing a route pass, but will prevent the receipt of the relevant ancillary services.
II. Definitions
- 11. For the purposes of these General Terms and Conditions:
- 11.1. “Vignette fee“ is the fee for the use of the paid road network under art. 10, para. 1, item 1 of the Roads Act.
- 11.2. “E-vignette“ is an electronic document within the meaning of Art. 3, para. 1 of the Electronic Document and Electronic Certification Services Act, certifying the payment of the relevant fee under Art. 10, para. 1, item 1 of the Roads Act and containing the registration number of the vehicle, its category, the date of payment of the fee and the period of validity.
- 11.3. “Route pass“ is a prepaid service for the use of paid sections of the Republican road network of vehicles with a Total Technically Permissible Maximum Mass (TTPMM) exceeding 3.5 tonnes. It is a toll product based on a time period and a distance travelled offered to domestic and foreign road users who do not have specialised on-board devices or tracking devices and drive vehicles with a total technically permissible maximum mass exceeding 3,5 tonnes
- 11.4. “Supplementary services" are the provision of confirmation of purchase of an e-vignette and reference to the validity of an e-vignette, the provision of confirmation of purchase of a route pass, a reference to its validity and the provision of a receipt with the requested route map, as well as other forms of feedback to the user that depend on the provision of an e-mail address.
- 11.5. “Website“ means the website of the National Toll Administration of the Road Infrastructure Agency at https://www.bgtoll.bg/, as well as https://web.bgtoll.bg/
- 11.6 “Mobile application“ is a computer program of the National Toll Administration of the Road Infrastructure Agency, named „BG Toll", designed to operate on mobile devices, which can be downloaded free of charge on such mobile device operating with Android or IOS.
- 11.7. “User" means any person who uses the website, the mobile application or the self-service terminal, whether or not he is a user of the toll network within the meaning of the Roads Act.
- 11.8. “Self-service terminal" is a computer-based system connected to the Central Electronic Charging System through which the road user declares the vehicle data, has the possibility to select an electronic charging product based on time and advance payment of toll by purchasing a route pass. The self-service terminal enables the payment and subsequent validation of time-based and distance-based charging products by pre-payment of toll, using payment instruments such as debit and credit cards, as well as fuel cards. The self-service terminal also provides an additional opportunity to verify the validity of an already acquired right to use the RRN through the Electronic Charging System.
III. Access to toll information
- 12. Information accessible through the website, the self-service terminals and the mobile application aims to guide the users on their rights and obligations in relation to the use of the paid road network.
- 13. The published information, which is based on regulations, including on which vehicles are liable for tolls, for the use of which roads are the tolls due, what is the amount of the fee, etc., may be changed by the issuing body.
- 14. The information published shall not serve as a reason for the user not to fulfil his obligations arising out of a regulatory act.
- 15. In the event that the user discovers an inaccuracy of the published information or a conflict with a normative act, the user should notify the National Toll Administration at the Road Infrastructure Agency of this circumstance in order to correct the inaccuracy.
- 16. The references to inaccurate information published on the website, the self-service terminals or the mobile application, where it conflicts with the applicable regulations, shall constitute a moral hazard of the user and shall not result in the user being exonerated of liability for non-compliance with his obligations.
IV. Payment of vignette fees and issuing of e-vignettes
- 17. The user can pay the due vignette fees and be issued an e-vignette via the website, the mobile application and the self-service terminals by declaring the following vehicle details: its category, the country of registration, the emission class and its registration number, as well as the period of validity and the method of payment. For the mobile application and the self-service terminals, the method of payment by a bank transfer by payment order is not applicable - payment is possible only through the envisaged card payment options.
- 18. When indicating the vehicle data, the user is responsible for correctly declaring its category, country of registration, emission class, period of validity and registration number. The registration number shall be entered without any gaps between the separate characters. The characters entered must accurately repeat the graphic representation of the registration number regardless of whether the characters are entered in Cyrillic or Latin characters. If the registration number contains characters that do not correspond to any of the characters in the Latin alphabet, the nearest character is displayed.
- 19. Where the period of validity is indicated, the user may indicate as the starting date the date on which he uses the relevant application, as well as any date within the next 30 days from the date of purchase.
- 20. Before paying the vignette fees, the user is obliged to check the declared vehicle identification data.
- 21. When requesting payment by bank transfer, the user will receive a payment identification code (PAY code), which should be indicated in the payment order in order to be able to be linked to the requested e-vignette. For the other conditions relating to the payment, the relevant rules of the bank selected by the user shall apply, the period for activating the vignette being not less than 3 (three) business days from the authorization of the payment. Payment orders are processed automatically and therefore the information must be filled in correctly. A separate payment order shall be prepared for each PAY code generated. Only the 13-digit PAY code in capital letters in Latin characters, with no spaces and no other information, shall appear in the basis for payment column. The amount calculated when generating the PAY code must correspond to the amount written in the payment order. In the event of errors in identifying the payment identification code, a manual reconciliation procedure shall be carried out which may lead to a significant delay in the start of the validation of the vignettes. In case of manual reconciliation, the National Toll Administration at the Road Infrastructure Agency will link the payment received to a requested e-vignette if there is sufficient information to identify the requested e-vignette, including information on previous e-vignettes from the same payer. To support this process, you can contact us through the contact details provided on the website of the National Toll Administration at the Road Infrastructure Agency, providing us with details and/or evidence to which e-vignette the payment made relates.
- 22. In the case of a request for a card payment, the rules of Section VI of these general terms and conditions shall apply.
- 23. Regardless of the start date of the validity period, the e-vignette becomes valid from the moment the payment of the due vignette fees is received to the account of the Road Infrastructure Agency, complying with the requirements for the method of payment chosen by the user and specifying the data for individualization of the e-vignette. In the case of payment by bank transfer, the e-vignette becomes active from the moment of reconciliation.
- 24. After paying the vignette fees, the e-vignette becomes valid for the vehicle data specified by the user. No refund shall be payable on vehicles where its category, country of registration, emission class or registration number has not been properly declared.
- 25. Where a discrepancy is found between the data of the vehicle with which the paid road network is used and the data of the vehicle for which the vignette fees are paid, the case constitutes an administrative offence and the rules of the Road Traffic Act shall apply.
- 26. The period of validity of the e-vignette is determined as stated by the user, but starts not earlier than the payment of the vignette fees to the account of the Road Infrastructure Agency. If the reconciliation takes place after the start of the period requested by the user but before the end of the same period, the vignette shall be valid until the expiry of the initially requested deadline. The vignette fees for the period between the beginning of the requested period and the time of receipt of the payment shall not be refundable. The vignette fees that have been received on the account of the Road Infrastructure Agency after the expiry of the stated period of validity of the e-vignette are not refundable.
- 27. If the vignette fees are paid two or more times within a calendar day, any additional amount paid after the first one shall be refunded under the Tax and Social Insurance Procedure Code. The refund is allowed only if there is a complete match in the vehicle data and the validity periods are the same (include the same calendar days). In case the first vignette is purchased by a payment by bank transfer, a difference in the days of purchase up to three business days is allowed.
- 28. The National Toll Administration at the Road Infrastructure Agency is not responsible for late payments by payment service providers, as well as errors in payment transactions, including incorrect indication of the basis for payment.
V. Advance payment of toll and issuance of a route pass
- 17. The user can pay the toll fees due in advance and be issued a route pass via the website, the mobile application and the self-service terminals by declaring the following vehicle details: the country of registration, registration number, its category, emission class and number of axles if the TTPMM, including trailers of the vehicle, is ≥12 tonnes (this Regulation does not apply to vehicles whose TTPMM, including trailers is <12 tonnes and buses), planned route from point A to point B (with four interim points), starting date and time of validity. The route pass may be purchased not earlier than 7 calendar days before the date of travel by a user registered in the electronic toll system and not earlier than 24 hours before the date of travel by an unregistered user, both valid for 24 hours from the declared start date and time of travel.
- 18. When indicating the vehicle data, the user is responsible for making a correct declaration of: the country of registration, registration number, its category, emission class and number of axles if the TTPMM, including trailers of the vehicle, is ≥12 tonnes (this Regulation does not apply to vehicles whose TTPMM, including trailers is <12 tonnes and buses), planned route from point A to point B (with four interim points), starting date and time of validity. The registration number shall be entered without any gaps between the separate characters. The characters entered must accurately repeat the graphic representation of the registration number regardless of whether the characters are entered in Cyrillic or Latin characters. If the registration number contains characters which do not correspond to any of the characters in the Latin alphabet, the nearest symbol shall be displayed.
- 19. Before paying for the route pass, the user is obliged to check the vehicle identification data he declares.
- 20. In the case of a request for a card payment, the rules of Section VI of these general terms and conditions shall apply.
- 21. Regardless of the start date of the validity period, the route pass becomes valid from the moment the toll charges due are paid to the account of the Road Infrastructure Agency, complying with the requirements for the method of payment chosen by the user and specifying the data for the individualisation of the route pass.
- 22. After payment of the toll, the route pass becomes valid for the vehicle data specified by the user.
- 23. No refund shall be payable on road vehicles where its country of registration, registration number, category, emission class and number of axles if the TTPMM, including vehicle trailers, is ≥12 tonnes (this rule does not apply to vehicles whose TTPMM, including trailers is <12 tonnes and buses), planned route from point A to point B (with four interim points), starting date and time of validity are not correctly declared. 24. Where a discrepancy is found between the data of the vehicle with which the paid road network is used and the data of the vehicle for which toll is paid by means of a purchased road pass, the case constitutes an administrative violation and the rules of the Road Traffic Act shall apply.
VI. Conditions for bank card payments
- 29. When paying for an e-vignette and a route pass via the website of the National Toll Administration at the Road Infrastructure Agency or the mobile application, the option to pay the due road fee by means of a bank card may be chosen. In such cases, the payment can be made directly via the website, which serves as a virtual POS device, without the need for physical presentation of the bank card.
- 30. For payments in this order, bank cards VISA, MasterCard, Maestro, cards with the BORICA logo and Diners Club International & Discover cards are accepted.
- 31. When choosing this payment method, the user will be referred to an additional website, which forms part of the website of the Road Infrastructure Agency, to complete the payment.
- 32. The operator of the website serving as a virtual POS device shall participate in payment authentication schemes. When using the website that serves as a virtual POS device according to the type of bank card used, the authentication schemes Verified by Visa, MasterCard SecureCode and BORICA secret code for payments via the Internet apply and the user must comply with the relevant rules for his identification (card number entry, period of validity, security codes, card-holder name, etc.).
- 33. According to the type of the bank card, a 3D security code for additional authentication of the payment may also be applied.
- 34. A payment, ordered to the account of the Roadmap Infrastructure Agency, may not be accepted or the requested route pass may not be activated upon receipt of a notification under the rules of the International Card Organizations Visa, MasterCard and Diners Club International & Discover or by the issuing bank of the card that the payment was unlawfully ordered with a false, invalid and/or irregular bank card or made without the knowledge and/or the consent of the authorised card-holder. The payment may not be accepted or may not be accounted for in case of a found misuse of the website or the mobile application of the National Toll Administration at the Road Infrastructure Agency, a violation of the General Rules, as well as a suspected or established violation of the laws of the Republic of Bulgaria and the acts of the European Union.
- 35. The National Toll Administration and the Road Infrastructure Agency are not responsible for accepting and accounting for payments for which no timely notification has been submitted pursuant to para. 34 of these General Terms and Conditions that they were made without the knowledge and/or the consent of the authorised card-holder. The terms and conditions of the bank that issued the user's bank card shall apply to the consequences of the payment in such cases.
- 36. The Road Infrastructure Agency does not accept payments to other persons, nor payments with grounds not related to the payment of toll charges under Art. 10, para. 1 of the Roads Act.
- 37. When using the virtual POS device, the users are obliged to use only bank cards in respect of which users are authorised card-holders. It is prohibited to use bank cards without the knowledge and the consent of the authorised card-holder, as well as the use of invalid cards and cards and/or card data obtained illegally (in cases of lost or stolen card, etc.), and the Road Infrastructure Agency reserves the right to refuse to accept payment and/or not to activate the requested vignette in case of suspicion of such circumstances.
- 38. If a user check reveals that the e-vignette or the route pass requested by them is not valid, the user may seek information through the indicated means of contact with the National Toll Administration at the Road Infrastructure Agency. Where the payment has not been accepted or accounted for because of suspected misconduct, the user may confirm the payment by providing additional evidence that he is an authorised card-holder and that the payment was ordered with his knowledge and consent.
- 39. The user can obtain information from the National Toll Administration at the Road Infrastructure Agency on whether the payment has been accepted and whether the vignette has been activated after providing information on the ordered payment.
- 40. The Road Infrastructure Agency is not responsible for actions undertaken by third parties, including the bank that issued the bank card to the user, retention actions, refusals to execute the user's orders, etc. These relations are governed by the contracts signed by the user and the person concerned.
- 41. The payment details shall be encrypted and exchanged in compliance with SSL/HTTPS standards. If, when accessing the website, your terminal indicates that there is a problem with these certificates (including the title of the page lacking a symbol in the form of a yellow padlock, or if a symbol in the form of a red X is placed), do not submit payment details as in these cases the Road Infrastructure Agency cannot guarantee the security of information and is therefore not responsible for it.
- 42. The user may waive the payment order until the final payment details have been entered. After entering the payment details, it may not be processed by the electronic system if the connection to the user's terminal is disconnected before the operation is completed. In these cases, the Road Infrastructure Agency cannot receive the payment and therefore the route pass will not be valid. The user is obliged to monitor the occurrence of such circumstances and, if necessary, to seek additional information from the National Toll Administration at the Road Infrastructure Agency whether the payment has been accepted/accounted for.
VII. Verification of the validity of an e-vignette
- 43. The user may verify the validity of an e-vignette by registration number and country of registration of the vehicle, including of one of which he is not the owner. The verification is of a strictly informative nature and cannot be considered as proof of payment of the due vignette fees.
- 44. The opportunity for verifying the validity of an e-vignette should be used in good faith, and in the case of a large number of requests a refusal to process requests submitted by a specific terminal or by a specific network may be envisaged.
- 45. The information provided in a verification of validity cannot be considered final as long as circumstances may occur after the issue of the verification that affect the validity of the generated e-vignette.
VIII. Verification of the validity of the route pass
- 43. The user may verify the validity of a route pass by registration number and country of registration of the vehicle, including of one of which he is not the owner. The verification is of a strictly informative nature and cannot be considered as proof of payment of tolls due.
- 44. The opportunity to verify the validity of a route pass should be used in good faith, and a large number of requests may include refusal to process requests submitted by a specific terminal or by a specific network.
- 45. The information provided in the validity verification cannot be considered final as long as circumstances may occur after the issue of the verification that affect the validity of the generated route pass.
IX. Relationship with third parties
- 46. Under the Roads Act in order to facilitate the users, third parties can provide the possibility to pay vignette fees and issue an e-vignette, as well as to prepay tolls by purchasing a route pass. In these cases, the third party concerned is responsible for checking the requested e-vignette/route pass against the data declared by the user before payment of the e-vignette/ route pass. Errors committed by third parties do not give rise to the reimbursement of the e-vignette or toll charges paid, nor would they give rise to an exemption from administrative liability of the driver or the owner of a vehicle for which an error was made in the advance payment of toll by purchasing a route pass.
- 47. Those third parties provide the possibility to pay for e-vignettes/route passes at an own risk and responsibility. The National Toll Administration at the Road Infrastructure Agency does not directly control the activities of these third parties and is not responsible for their actions, including late payment, errors in requesting an e-vignette/route passes, etc. If, when monitoring the processes in the relationship between these third parties and the Road Infrastructure Agency, it is found that a delay, an error in entering or an inability to enter data is due to a malfunction of the electronic toll system at the Road Infrastructure Agency, which affected all channels available to the user for selling e-vignettes/route passes, then the relevant user affected by the delay, error or inability to enter data shall be deemed to have used the paid road network with a valid and active e-vignette/route pass. This rule applies only to the duration of the malfunction and the user is obliged to pay for the e-vignette/route pass as soon as possible - once another sales channel becomes available or the malfunction is corrected.
- 48. The National Toll Administration at the Road Infrastructure Agency is not responsible for obligations assumed by third parties to repay sums, cancellation of contracts at the discretion of the user, exercise of the right to complain, etc.
- 49. The National Toll Administration at the Road Infrastructure Agency is not responsible for the content of websites that redirect to the website of the National Toll Administration at the Road Infrastructure Agency.
- 50. The National Toll Administration at the Road Infrastructure Agency is not responsible for the content and functionality, the general operating conditions and the personal data protection policies on websites, references to which are found on the website of the National Toll Administration at the Road Infrastructure Agency, and the linked https://www.bgtoll.bg/ and https://prod-bg.tecspayment.com/tecsweb/
X. Intellectual Property
- 51. All publications, the layout of the website, as well as applications related to the website, the mobile application and the self-service terminals are protected as objects of copyright under the Copyright and Neighbouring Rights Acts.
- 52. The National Toll Administration at the Road Infrastructure Agency retains all its rights over the specified intellectual property objects and their sharing on the website, the mobile application or the self-service terminals does not constitute consent for the use of these intellectual property objects by third parties.
- 53. All intellectual property of third parties published by the National Toll Administration at the Road Infrastructure Agency shall be used with the appropriate consent of the respective right-holders.
XI. Other arrangements
- 54. The National Toll Administration at the Road Infrastructure Agency is part of the state administration, exercising power under explicit legal authority.
- 55. Regarding the activities of the National Toll Administration at the Road Infrastructure Agency, the provisions of the Electronic Commerce Act and the Consumer Protection Act do not apply as they do not apply to the activities of public authorities.
